AREAS OF PRACTICE

PERSONAL INJURY

A personal injury occurs when a person has suffered some form of injury, either physical or psychological, as the result of an accident caused by the violation of one’s rights for which the law allows an action to recover damages.

The most common type of personal injury claims are traffic accidents, accidents in the work place, assault claims, accidents in the home, aviation, nursing home neglect and sexual abuse.

If you have been seriously injured because of the negligence or wrongdoing of another party, you may be eligible to file a personal injury lawsuit to seek compensation for the damages you have suffered. Personal injury claims, also known as “tort” claims, follow specific provisions established by the state in which you reside. However, most states follow the same guidelines for personal injury lawsuits.

Compensation can be recovered for pain and suffering, medical costs, lost income capacity, lost earning capacity, and more. All damages include present and future expected losses. You may also be eligible to recover punitive damages if you can prove the defendant's conduct was intentional or malicious.

If you or a loved one has suffered a serious personal injury due to the negligence or wrongdoing of another party, it is important to seek the help of an experienced personal injury attorney who will protect your legal rights and maximize your interests. Please contact us today to speak to a qualified personal injury lawyer FREE OF CHARGE. The initial consultation is free, and I will come to you if necessary. For personal injury claims, there is no fee unless you collect.

WORKERS COMPENSATION

"Workers' compensation" refers to a system of laws outlining specific benefits to which injured employees are entitled, and the procedures for obtaining such benefits. Every state has its own workers' compensation laws, which are contained in statutes, and vary somewhat from state to state. In addition, there are special workers' compensation laws for employees of the federal government, and still others for workers in specific types of industries such as railroad employees.

Under the law in most states, every business must have some form of workers' compensation insurance to cover injured employees. Filing a workers' compensation claim is similar to filing an insurance claim; it isn't a lawsuit against an employer, but rather a request for benefits.

Workers' compensation is a no-fault system, where an injured worker's own negligence, or the negligence of his or her employer or co-workers is not put at issue; rather, the injured employee is simply covered for his or her work-related injuries.

PROBATE

Probate law has to do with the handling of an estate when someone, such as a family member or other loved one, passes away. These are the laws that make sure that the creditors are paid properly and that assets are distributed to the “heirs,” or the descendant. When you find yourself in a situation where you’ll be dealing with probate law, it’s a good idea to already have in mind what you are going to need to do.

Probate is a legal process that begins with a “petition” (a request) to open the estate and name a personal representative who is responsible for the administration of the deceased’s property. The next step is when an official Notice of Creditors is printed in a local newspaper and Notice of Administration is sent to other involved parties. Creditors then have a set amount of time to file their claims from the first date of publication. Then the personal representative can pay the debt and distribute the remaining estate. Finally, a petition for discharge is filed, and the estate is closed.

If you are currently in a situation where you’ll be dealing with the Tennessee state court system in relation to a probate or estate related matter, or if you think that you will be in this kind of situation in the near future, it is important that you hire an attorney that knows the ins and outs of Tennessee probate law.

Handling Probate laws is not an easy ordeal depending on the circumstances of each estate, which is one of the many reasons why it is often a good idea to hire an attorney experienced in the field of Tennessee probate law to help you with the matter. Having an attorney on your side will help you make sure that the estate and assets of your loved one’s particular case are handled in a proper and legal fashion.

Civil litigation generally includes all disputes that are formally submitted to a court, about any subject in which one party is claimed to have committed a wrong, but not a crime. Although civil litigation takes many forms depending on the type of case, in general, this is the legal process that most people think of when the word “lawsuit” is used. Therefore, civil litigation is the process used if no other arrangement is agreed upon for all sorts of asserted wrongs.
